3. Trial Period Disclaimer

During any trial or demo period, we do not guarantee the storage, security, or retention of any data entered or generated within the platform. All information may be deleted at the end of the trial period. Users are advised not to rely on trial data for permanent records.

4. Use of AI and Accuracy Disclaimer

TopPercent uses artificial intelligence and machine learning technologies to generate assessments, insights, and recommendations. While we strive for high accuracy, AI models can make errors or produce unexpected results. We make no warranties, express or implied, regarding the accuracy, completeness, or reliability of any AI-generated output.

TopPercent and its affiliates shall not be held responsible or liable for any decision, action, or outcome resulting from reliance on AI-generated content, insights, or recommendations.

5. Data Collection and Privacy

We collect limited data necessary to provide and improve our services. Your data is handled in accordance with our Privacy Policy. You agree not to upload or share any sensitive or personal data unless required for educational purposes within the platform.

6. User Responsibilities

• You agree to use the platform only for lawful educational and institutional purposes.
• You shall not misuse, attempt to hack, or interfere with the functioning of the system.
• You shall not upload copyrighted or unauthorized content without permission.

8. Payment and Subscription

After the trial period, continued access to our services requires an active paid subscription. Pricing, billing cycles, and payment terms are specified at checkout. Failure to make timely payments may result in suspension or termination of access.

9. Refund and Cancellation Policy

We aim to ensure satisfaction with our services. However, the following refund and cancellation terms apply:

• Subscription Fees: All payments made for active subscriptions are non-refundable once the subscription period begins.
• Trial Period: During the free trial, users can cancel anytime without charge. No refunds are applicable for trials.
• Cancellations: Users can cancel their subscription anytime through their account settings. Cancellation will stop auto-renewal but will not refund past charges.
• Special Cases: In rare cases of technical errors or double billing, users may contact our support team within 7 days for resolution or credit adjustments at our discretion.
• Service Suspension: If access is suspended due to violation of terms, no refund will be provided.
• AI and Performance Disclaimer: As results depend on AI algorithms and user interaction, we do not offer refunds based on dissatisfaction with AI outputs, accuracy, or performance.

By purchasing or subscribing, you acknowledge and agree to these refund and cancellation terms.

10. Service Availability and Maintenance

We strive to ensure continuous access to our services but may occasionally perform maintenance or updates. We are not liable for any downtime, delay, or disruption due to maintenance, technical issues, or events beyond our control.

11. Limitation of Liability

To the fullest extent permitted by law, TopPercent and its affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising out of your use or inability to use the platform, including but not limited to data loss, AI inaccuracies, system errors, or unauthorized access.

12. No Guarantee of Results

TopPercent provides tools to assist in learning and assessment, but outcomes depend on how the platform is used. We make no guarantee regarding improvements in academic performance or institutional efficiency.

13. Modifications to Terms

We may revise these Terms from time to time. The updated version will be effective immediately upon posting. Continued use of the platform after changes constitutes your acceptance of the new Terms.

14. Termination

We may suspend or terminate access if you violate these Terms or misuse the service. Upon termination, your right to use the platform immediately ceases, and all related data may be deleted.

15. Governing Law

These Terms shall be governed by and construed under the laws of India, without regard to its conflict of law provisions. Any dispute shall be subject to the jurisdiction of courts in Bengaluru, India.
